Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Tinker Studios, Inc. (“we”, “our”, or “us”) governing your use of Consumed, our mobile application and any associated services (together, the “Service”).
By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use Consumed
You must be at least 13 years old (or 16 in the EU/UK) to use the Service. By using Consumed, you represent that you meet this age requirement and have the legal capacity to enter into these Terms. If you use Consumed on behalf of an organization, you represent that you’re authorized to bind that organization to these Terms.
2. Your account
- You’re responsible for keeping your account credentials secure. Do not share your password.
- You’re responsible for everything that happens under your account.
- Provide accurate information when you sign up, and keep it current.
- One account per person. Don’t impersonate others.
- Let us know at consumed@tinkerstudiosinc.com if you suspect your account has been compromised.
3. Your content
“Your Content” means anything you log, write, upload, or otherwise submit to the Service — including your items, notes, ratings, profile picture, and profile information.
- You own Your Content.We don’t claim ownership of it.
- You grant us a license to operate the Service. Specifically, you grant Tinker Studios, Inc. a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely to provide, improve, and secure the Service — for example, by syncing your items across your devices or showing them to the friends you’ve granted access to.
- You’re responsible for Your Content.You represent that you have the rights to post what you post, and that Your Content doesn’t violate any law or these Terms.
- You can delete Your Content at any time, or delete your account entirely from within the app. Residual backups may persist briefly for technical reasons before they are permanently removed.
4. Acceptable use
Don’t do any of the following with the Service:
- Harass, threaten, or abuse other users — including through comments, reports, or attempts to contact.
- Post content that is unlawful, defamatory, sexually explicit, hateful, or that infringes someone else’s intellectual property rights.
- Impersonate any person or entity, or misrepresent your affiliation with anyone.
- Scrape, crawl, or otherwise collect data from the Service without our written permission.
- Attempt to circumvent privacy settings (for example, trying to access content from a private profile you don’t follow).
- Reverse-engineer, probe, or interfere with the Service; introduce malware; or attempt to gain unauthorized access to any account or system.
- Use the Service to send spam or unsolicited messages.
- Use the Service for any illegal purpose.
We may remove content, suspend accounts, or report activity to the appropriate authorities if we believe these rules have been broken.
5. Social features
- When your profile is public, other users can see your profile, items, and notes. When it’s private, only people whose follow requests you’ve approved can see them.
- Following another user gives you access to the items they’ve chosen to share. Unfollowing or being blocked removes that access.
- Blocking a user prevents them from viewing your profile, and prevents you from viewing theirs.
- You can report a user in-app. Reports go to consumed@tinkerstudiosinc.com for review.
6. Third-party metadata
Consumed uses public APIs — including Open Library, the iTunes Search API, and TMDb — to fetch metadata about the things you log (titles, cover art, release years, and similar). This content belongs to the respective providers and is subject to their terms. We don’t guarantee it’s accurate or available.
7. Our intellectual property
The Service itself — including the Consumed name, logo, interface, code, and design — is owned by Tinker Studios, Inc. and protected by intellectual property laws. You don’t get any ownership in our IP by using the Service. You’re granted only a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.
8. Feedback
If you send us feedback, suggestions, or ideas, we may use them freely and without obligation to you. We appreciate them.
9. Suspension and termination
You may stop using the Service at any time and delete your account from within the app. We may suspend or terminate your account if you break these Terms or create risk or legal exposure for us or other users. When practical, we’ll give you notice first. Some provisions of these Terms — such as Sections 3 (license), 10 (disclaimers), 11 (liability), and 13 (governing law) — survive termination.
10. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied. We don’t warrant that the Service will be uninterrupted, error-free, secure, or that it will meet your requirements. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law, Tinker Studios, Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages; loss of profits, data, goodwill, or other intangible losses; or damages resulting from unauthorized access to or alteration of your content. Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) USD $50.
12. Indemnification
You agree to defend, indemnify, and hold harmless Tinker Studios, Inc. from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your use of the Service, (b) Your Content, or (c) your violation of these Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts. If you are a consumer, nothing in this section overrides any mandatory consumer-protection rights you have under the law where you live.
14. Changes to these Terms
We may update these Terms from time to time. If the changes are material, we’ll let you know in-app or by email before they take effect. Continued use of the Service after an update means you accept the new Terms.
